WayTrade US LLC ("WayTrade," "we," "us," or "our") respects your privacy and is committed to protecting personal information. This Privacy Policy ("Policy") describes how we collect, use, disclose, store, and otherwise process personal information when you interact with the WayTrade website, hosted software platform, software applications, dashboards, integrations, notifications, reports, documentation tools, analytics, artificial intelligence-enabled features, APIs and related products and services (collectively, the "Services").
WayTrade operates a cloud-based technology platform that facilitates and manages commodity transactions between buyers and suppliers, including transaction management, documentation, collaboration, analytics, reporting, workflow automation, and related services.
This Privacy Policy is incorporated into and subject to the WayTrade Terms of Service and applies to personal information processed in connection with the Services.
This Policy applies to:
- visitors to the WayTrade website;
- individuals who request demos, information, or communications from us;
- customers and prospective customers;
- authorized users designated by Customers of the Services;
- authorized account managers;
- Customer organizations that participate in the Services as buyers, suppliers, trading companies, or other authorized commercial participants; and
- individuals whose information may be processed through the Services on behalf of customers.
This Privacy Policy does not modify any contractual obligations relating to customer data contained in any applicable Services Agreement, Terms of Service, Order Form, Statement of Work, data processing agreement, or other written agreement governing the Services.
- INFORMATION WE COLLECT
- Information You Provide Directly
We may collect information that you voluntarily provide to us when you:
- request information, demonstrations, or support;
- contact us;
- register for an account;
- subscribe to communications;
- enter into agreements with us;
- connect third-party integrations; or
- otherwise interact with the Services.
This information may include:
- name;
- company name;
- email address;
- job title;
- phone number;
- account credentials;
- billing information;
- communications, requests, uploads, support inquiries, and feedback; and
- product interests, and participation preferences.
- Customer Content and Integration Data
In connection with providing the Services, customers may submit, upload, synchronize, transmit, integrate, or otherwise make available data, records, documents, communications, prompts, requests, reports, operational information, transaction information, configuration information, and other content (collectively, "Customer Content").
Depending on how the Services are used, Customer Content may include:
- account and organization information;
- commodity, transaction, pricing, and logistics data;
- purchase orders, contracts, bids, quotations, settlement information, shipment information, and other transaction records;
- delivery terms, quality specifications, certifications, Certificates of Analysis, pre-load inspection reports, and traceability documentation;
- invoices, inventory information, market index assessments, and operational reports;
- business communications, including emails, messages, and support requests;
- business contact information relating to customer personnel, authorized users, counterparties, or other individuals included in Customer Content;
- configuration settings and account preferences;
- information obtained through customer-authorized integrations with third-party services;
- documentation and reports received from third parties on behalf of customers, including inspection reports, Certificates of Analysis, and traceability documentation; and
- any other information provided by or on behalf of customers in connection with the Services.
The Services facilitate commercial transactions among customer organizations. Customer Content may include information relating to multiple transaction participants, including buyers, suppliers, trading companies, brokers, authorized representatives, and other commercial counterparties. Customers are responsible for ensuring they have the authority to provide such information through the Services.
With respect to Customer Content processed through the Services on behalf of customers, WayTrade acts as a technology platform and, where applicable under relevant privacy laws, as a service provider, processor, or similar intermediary, processing such Customer Content only on behalf of and in accordance with customer instructions and applicable agreements.
WayTrade does not independently verify the accuracy, completeness, or reliability of any data provided through the Platform. Customers are responsible for ensuring they have all rights, permissions, notices, and, where required by applicable law, consents necessary to provide Customer Content to WayTrade and to authorize WayTrade's access to any customer-authorized third-party services.
- Information Collected Automatically
When you use the Services, we may automatically collect technical and usage information, including:
- IP address;
- browser type and version
- device identifiers;
- operating system and device characteristics;
- access dates and times;
- pages, features, and functions accessed;
- usage activity;
- session identifiers and authentication information;
- log files, performance metrics
- diagnostic information; and
- cookie and tracking technology information.
We and our service providers may use cookies, pixels, web beacons, local storage, analytics tools, session technologies, and similar technologies to operate, authenticate, secure, maintain, analyze, personalize, and improve the Services, understand how users interact with the Services, and measure the effectiveness of our communications. You may be able to control cookies through your browser settings. However, disabling certain cookies may affect the functionality of the Services.
HOW WE USE INFORMATION
We may use information to:
- provide, operate, maintain, and support the Services;
- generate reports, dashboards, documentation, analytics, alerts, and Outputs;
- authenticate users and administer accounts;
- process transactions and manage billing;
- communicate with users and customers;
- provide customer support;
- facilitate integrations with Third-Party Services;
- provide outage monitoring and notification services;
- maintaining transaction records;
- enabling collaboration between authorized users;
- generating reports and analytics;
- improve and develop the Services;
- improve our automation, analytics, and AI technologies;
- maintain security and prevent fraud or misuse;
- comply with legal obligations;
- enforce our agreements;
- conduct internal analytics, research, and business operations; and
- product updates, beta programs, surveys, events, and marketing communications.
For avoidance of doubt, customers retain ownership of their Customer Content. WayTrade processes Customer WayTrade's rights to generate, use, and commercialize aggregated, anonymized, or de-identified data derived from the Services do not affect customer ownership of the underlying Customer Content.
- AI TECHNOLOGIES AND OUTPUTS
The Services may utilize artificial intelligence, machine learning, predictive analytics, automation technologies, and related technologies (collectively, "AI Technologies") to generate analyses, summaries, forecasts, recommendations, alerts, classifications, documentation, transaction insights, market intelligence, pricing and inventory insights, logistics and supply chain recommendations, trade and operational reports, workflow suggestions, risk indicators, and other outputs (collectively, "Outputs").
Outputs are probabilistic in nature and may contain inaccuracies, incomplete information, outdated information, biases, or incorrect conclusions. Outputs are intended to assist operational and business decision-making and are not guaranteed to be accurate, complete, reliable, or suitable for any specific purpose.
Outputs should not be relied upon as the sole basis for technical, operational, legal, financial, compliance, security, employment, strategic, or business decisions.
We do not use customer-specific confidential data to train artificial intelligence models without customer consent. We may use aggregated, anonymized, or de-identified information to improve and develop the Services and AI Technologies.
- HOW WE SHARE INFORMATION
We may share information:
- with service providers, vendors, contractors, cloud hosting providers, analytics providers, infrastructure providers, communications providers, and security providers that assist us in operating the Services;
- with third-party integration providers authorized by Customer;
- in connection with mergers, financings, acquisitions, asset sales, or similar business transactions;
- to comply with legal obligations, lawful requests, or legal process;
- to protect the rights, security, and integrity of the Services or other persons; or
- with your consent or at your direction.
We do not sell personal information for monetary consideration.
- AGGREGATED AND DE-IDENTIFIED INFORMATION
We may aggregate, anonymize, or de-identify information collected through the Services so that it no longer identifies, and cannot reasonably be used to identify, an individual or customer. We may use such aggregated or de-identified information for lawful business purposes, including analytics, benchmarking, research, product development, marketing, and improvement of the Services and AI Technologies.
- DATA SECURITY
We aim to protect personal information through reasonable administrative, technical, and organizational security measures designed to safeguard information processed through the Services. However, despite our safeguards and efforts, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure.
Accordingly, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or improperly access, collect, use, or disclose information.
- DATA RETENTION
We retain personal information for as long as reasonably necessary to:
- provide the Services;
- fulfill the purposes described in this Policy;
- comply with legal obligations;
- resolve disputes; and
- enforce our agreements.
We may retain aggregated or de-identified information indefinitely.
- INTERNATIONAL DATA TRANSFERS
The Services are operated in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, processed in, and stored in the United States and other jurisdictions where data protection laws may differ from those in your jurisdiction.
Where required by applicable law, we take reasonable measures designed to ensure that personal information remains protected in accordance with this Policy.
- PRIVACY RIGHTS
Depending on your jurisdiction and our role with respect to the information (for example, as a controller or processor), you may have certain rights regarding your personal information, including the right to:
- access personal information we maintain about you;
- request correction of inaccurate information;
- request deletion of certain information;
- object to or restrict certain processing activities; and
- request portability of certain information, where applicable.

Where we process Customer Content solely on behalf of a customer, requests relating to that information should generally be directed to the applicable customer, who controls the purposes and means of processing.
If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”) and other applicable California privacy laws, including the right to request access to, correction of, or deletion of certain personal information, subject to applicable exceptions and limitations. WayTrade does not sell personal information for monetary consideration or share personal information for cross-context behavioral advertising as defined under applicable California law.
If you are located in the European Economic Area (“EEA”) or the United Kingdom (“UK”) and believe we are unlawfully processing your personal information, you also have the right to lodge a complaint with your local data protection supervisory authority. - THIRD-PARTY SERVICES
The Services may integrate with or rely upon Third-Party Services, including cloud service providers, identity and authentication providers, analytics providers, artificial intelligence providers, customer-authorized business applications, and other technology providers. The Services may also process information originating from third-party sources, such as pre-load inspection reports, Certificates of Analysis, market data providers, and other documentation supplied by or on behalf of customers. We are not responsible for the privacy practices, content, availability, security, or operations of any Third-Party Services. Your use of and interactions with Third-Party Services are governed by the applicable third party's terms, conditions, and privacy policies.
- CHILDREN'S PRIVACY
The Services are not directed to individuals under the age of 18, and we do not knowingly collect personal information from minors.
- CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time. The updated version will be indicated by an updated "Last Updated" date and will become effective when posted. If we make material changes to this Privacy Policy, we may provide notice through the Services or by other appropriate means.
Your continued use of the Services after any updated Privacy Policy becomes effective constitutes your acceptance of the revised Policy.
